By accessing or using Modelers Central website by Model Ship Building College Pty Ltd (“Modelers Central”) or services provided by Modelers Central, you agree to be bound be these Terms & Conditions (“Terms”) and our Privacy Policy, incorporated herein by reference. Modelers Central shall collectively be referred to herein as “we” and/or “us”. If you are accessing and using the Website on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, “you” and “your” will refer to that company or other legal entity. These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, you may not access or use the Website.
1.0 INFORMATION ABOUT US

3.0 CONTRACT CONCLUSION
If you submit an order for goods via this Website, your order is an offer to us to buy the goods on our website. We will acknowledge receipt of your order by sending you an automatically generated email accepting your order. With this email the contract will be concluded. The contract will relate only to those specific goods which are referred to in our email confirming our acceptance of your order. You should read and check the details in this email to ensure that they are correct. If the details in the email confirming your order are not correct, or if you are not satisfied with the details in the email, please contact us at [email protected] The contractual language is English. We store the contract’s content and will send you the details of your order via e-mail. The details about your recent orders can be found in your customer login.
4.0 PRICES
We shall use our reasonable endeavours to ensure that the prices as quoted on our site are correct. Information displayed on this site relating to pricing is subject to change by us without notice, but those on the site at the time of any order placed will be the prices applicable to that order. Where the correct price of the goods is less than our stated price, we will charge the lower amount on dispatch. If the correct price of the goods is higher than the price stated on our site, we may, if possible, reject your order at our discretion, in which case we will notify you of such rejection and the correct price for the goods.
5.0 SHIPPING & POSTAL CHARGES

All prices shown on our website exclude shipping & postal costs. Shipping & postal costs depend upon the items and value of your order and your delivery location.
Modelers Central ships to most destinations around the world.
When entering your delivery address details in the shopping cart please ensure you select the correct country from the drop down menu.
Shipping rates will depend on the value of your order and the delivery location. Shipping costs will be displayed at checkout. The total shipping costs include insurance.
Tracking details will be sent to you by email.
Delivery times depend on the destination of your order. Domestic delivery times are usually 2 to 4 business days. International delivery times are usually 6 to 10 business days.
A timber surcharge will be applied to all orders of timber strips and lengths of brass rod. This surcharge is applied due to the additional costs of shipping long items.
The total shipping and postal charge will be presented to you before you finalize and submit your order.
6.0 AVAILABILITY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times. Most items in our stock list are standard stock. There may be times when we are out of stock of a particular item. Should this occur we will advise you accordingly with an estimated date for delivery. Once the item is back in stock we will ship it to you immediately.
7.0 DELIVERY AND TRACKING
Delivery of your order will be made through the national postal service of your country.
We will deliver the goods ordered by you to the delivery address you provided at the time you made your order on the website. Delivery will be made according to the information on the product pages after your order is accepted. If you provide the wrong address, we are not obliged to re-send the order at our expense to the correct address.
As proof of delivery we require a Signature on Delivery for all orders.
We are not responsible for any delay in delivery caused by the unavailability of a person at the delivery address to accept delivery of your order. If there is no person available the postal service will leave a notification advising you how or where to make arrangements to collect your delivery. It is your responsibility to contact the postal service to arrange the collection or delivery of products that could not be delivered because you were unavailable.
Once your order is booked for collection by our postal service a tracking number will be sent by email to you. You can use this tracking number to track your order through the national postal service of your country.
We endeavour to dispatch all orders on the next business day after the order is received. During times of high demand there may be a delay of a few days in shipping your order. We are not able to guarantee the delivery day or time.
We are not responsible for goods lost, stolen or damaged in transit or for the late delivery of an order. An order lost, stolen or damaged in transit or the late delivery of an order does not constitute a failure of our responsibility to supply to you the goods you have ordered, and consequently does not entitle you to cancel the order.
8.0 CUSTOMS AND IMPORT DUTY
For international orders some countries apply Customs fees, duty, taxes or import terminal charges on goods imported into that country.
The receiver of the purchase is fully responsible for their country’s customs fees, duty, taxes, or import terminal charges that may apply to your order.
Should the receiver of the purchase refuse to meet these fees the order will be returned to Modelers Central postal address.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:
- the original shipping costs stated on the order invoice;
- the return shipping costs incurred by Modelers Central for the return of the order;
- any return entry Customs fees, duty, taxes or import terminal charges that may apply to the returned order;
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and
- the cost of any damage should the goods not be returned in their original condition.
When the order is returned Modelers Central will contact the purchaser by email notifying them of the final amount to be refunded.
9.0 PARTS REPLACEMENT
Any missing or broken part in your kit will be replaced for up to 30 days from the date of purchase. When you receive your kit you are required to carefully and thoroughly examine all the contents and familiarize yourself with the plans and instructions. If there is a missing or broken part advise us immediately. Check carefully as some parts of a model kit have to be made by the modeler from timber and fittings supplied in the kit. What may appear to be missing is in fact in the kit but has to be made, shaped or built by the modeler.
10.0 PRE-ORDERS
Pre-Orders can be made approximately one (1) month before we place an order to one of our suppliers. A Pre-Order selection button will be available on our website for a particular item. Full payment including shipping is required. Once a Pre-Order is made you will receive confirmation of your order and information on expected delivery.
By pre-ordering products, you acknowledge and agree to the following terms and conditions. Pre-order dates are estimates and subject to change; we do not guarantee the availability of the product at the estimated date. Your pre-order is non-refundable, except as required by applicable law. In the event of unforeseen circumstances affecting product availability, we reserve the right to cancel or delay pre-orders and will notify you promptly. Prices for pre-ordered items are fixed at the time of purchase. The sell price of a pre-order is not subject to any monthly special promoted in Modelers Central newsletter or any other promotional campaign. Any changes to the product specifications will be communicated before shipment. We are not liable for any potential changes in product features or delays. By completing a pre-order, you affirm that you have read, understood, and accepted these terms and conditions
11.0 PAYMENT
Payment for goods can be made by one of the following payment methods:

12.0 RIGHT TO CANCEL
You have the right to cancel the purchase of an order without having to give a reason at any time within 14 days of receiving your order. You must notify us of your cancellation in writing or in another durable medium to our contact address [email protected]
You are required:
- While in possession of the goods you are to retain them and take all reasonable care of them.
- To return the goods back to us in their original condition to our delivery address at your own cost (unless we delivered the item to you in error or the item is damaged or defective upon delivery to you) as soon as possible once you have cancelled the contract.
- You are responsible for the return shipping cost.
Once the order has been returned to Modelers Central a refund will be made to the purchaser for the purchase price of the goods less:
- the original shipping costs stated on the order,
- the cost of the return shipping should you not pay this cost; and
- the cost of any damage should the goods not be returned in their original condition.
When you return goods to us because you have cancelled the contract between us during the 14 days we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
You do not have any right to cancel a purchase:
- after it has been despatched from our warehouse and collected by our courier service.
- for the supply of goods the price of which is dependent on fluctuations in the financial market which cannot be controlled by the supplier;
- for the supply of goods made to your specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly;
- DVDs cannot be returned or exchanged unless the DVD is found to be faulty.
- Plans cannot be returned or exchanged.
- Electrically operated tools or equipment cannot be returned for refund or exchanged where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.
- Special Orders cannot be exchanged, canceled or returned for a refund.
13.0 MONTHLY SPECIALS
Please note there is no refund or exchange for our monthly specials as per distributed via email.
14.0 CANCELLATION BY US
We reserve the right to cancel the contract between us if, for example:
- we have insufficient stock to deliver the goods you have ordered;
- we do not deliver to your location/country; or
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order.
15.0 RETURNS AND REFUNDS POLICY
If you want a refund you must notify us by email to [email protected] within 30 days from the date of delivery of your order. You must provide a reason for wanting a refund.
If you have changed your mind Modelers Central may, at its sole discretion allow a refund or an exchange of goods.
A cost of goods refund will only be provided if the goods purchased are:
- not of acceptable quality; or
- do not match the description presented on our website; and
- returned to us in their original condition.
A cost of goods refund will not be made if you return the goods to us and they are found to have been altered in any way while in your possession. This includes the packaging containing the goods.
The following conditions apply to the return of goods:
- include a copy of the original invoice you received with your order.
- you are responsible for the return shipping cost and any associated import costs.
- you are required to pack the order carefully and securely.
- if returning a kit you are required to ensure the kit box is securely packaged and the internal contents of the kit box are made secure to avoid damage to the contents during transit to us.
- if on return to us the kit is found to be damaged in any way, either externally or any of the internal contents are damaged in any way, you will be responsible for the cost of replacing any such damage.
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee will apply to all returns
- goods returned with the claim that they are faulty will be repaired or replaced at the sole discretion of Modelers Central.
- where goods are returned with the claim that they are faulty or incorrectly supplied and these goods are subsequently found not to be faulty or not incorrectly supplied, the purchaser will be responsible for the return shipping cost.
The following stock items can not be returned or exchanged:
- Special Orders cannot be returned or exchanged.
- DVDs – unless the DVD is found to be faulty.
- Model Ship Plans
- Electrically operated tools where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:
- the original shipping costs stated on the order invoice;
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and
- the cost of any damage should the goods not be returned in their original condition.
- the cost of return shipping should you not meet that cost.
When the order is returned Modelers Central will contact the purchaser by email notifying them of the final amount to be refunded.
By returning the goods to us you have cancelled the contract between us. We will process the refund due to you as soon as possible and, in any case, within 30 days of the date of receiving the returned goods.
16.0 COPYRIGHT
17.0 TITLE AND RISK
You will become the owner of the goods you have ordered when they have been delivered to you and we have received clear funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
18.0 LIABILITY
We are not responsible if you cannot access the site properly or at all because of any event outside our control, for example (without limitation) the performance of your or our ISP, your browser or the internet. This site relies in part on software to work. Whilst we will monitor the site, we cannot guarantee that the site or any individual feature of the site will be error free, available all the time and/or free from viruses. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content. Nothing in these terms will affect any liability we may have:
(a) for fraudulent misrepresentation;
(b) for death or personal injury arising from our negligence:
(c) under Part I of the Consumer Protection Act 1987;
(d) for breach of any condition as to title or quiet enjoyment of or in relation to any goods supplied by us;

(e) in relation to any other liability, including any liabilities under sale of goods or supply of services legislation, that may not by applicable law be excluded or limited.
19.0 EVENTS BEYOND OUR CONTROL
We will have no liability to you for any delay in delivering goods you have ordered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion.
20.0 INVALIDITY
If any part of these terms is unenforceable, the enforceability of any other part of these terms will not be affected.
21.0 LAW AND JURISDICTION
These terms are governed by Australian law, and any contracts formed between via this site will be governed by Australian law. The Australian courts will have exclusive jurisdiction over any dispute relating to these terms or any contracts between us.
22.0 GENERAL
Modelers Central is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by a customer while using any good purchased from or supplied by Modelers Central. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the greatest extent permitted by law.
Modelers Central reserves the right to refuse service to any customer who either explicitly or implicitly threatens, abuses, harasses or makes defamatory remarks via any form of communication to any employee or officer of Modelers Central.
Refusal of service to a customer also applies to explicit or implicit threats to Modelers Central via any form of communication.
Any order placed by a customer who is refused service will be cancelled and a refund processed.
No correspondence will be entered into in relation to the refusal of service to a customer.
Relevant and appropriate legal action may be taken against the perpetrator of any defamatory statements about Modelers Central made by any form of communication including social media.
Using Modelers Central website to access, send or post any material of an offensive, obscene, pornographic, threatening, abusive or defamatory nature is a breach of these terms and conditions.
23.0 NOTICES
All notices you send us must be sent to the contact details on this Website. We may give notice to you at either the e-mail or postal address you provide to us when making a purchase. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that the e-mail was sent to the specified e-mail address of the addressee.

The Modelers Central mobile message service (the “Service”) is operated by Modelers Central (“Modelers Central”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Modelers Central’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Modelers Central through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list.
Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Modelers Central. Your participation in this program is completely voluntary.

Modelers Central Members Program Terms & Conditions
By applying to become a Modelers Central Member the applicant agrees to be bound by these Modelers Central Membership terms and conditions. These terms and conditions are binding on an applicant upon the processing of the application.
· Only individuals can apply to become a Modelers Central Member. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
· Modelers Central may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application from an individual to become an member.
· To apply to become a Modelers Central Member, the applicant must complete and submit the on-line application at www.www.modelerscentral.com and pay the relevant non-refundable membership fee.
· A Modelers Central Member may hold one (1) membership only.
· Modelers Central Member benefits are determined by Modelers Central from time to time and may include discounts for products purchased at Modelers Central.
· Discounts only apply to the Modelers Central Member named on the membership card.
· The benefits of a Modelers Central Member are non-transferable and are not redeemable for cash.
· Modelers Central Membership is valid for a period of 24 months from date of application and fee payment or is terminated or cancelled by Modelers Central (in its absolute discretion) or until the Cardholder notifies Modelers Central at [email protected] that he/she wishes to terminate their Membership. If membership is terminated the membership fee is non-refundable.
· Modelers Central is not responsible for stolen or lost Cards or Cards that are used fraudulently. The Cardholder must report a stolen or lost Card to Modelers Central immediately. The member’s existing Card will be cancelled and a new Card issued.
· All membership cards remain the property of Modelers Central. Cards must be returned to Modelers Central immediately on demand by Modelers Central.

· Modelers Central reserves the right to suspend or terminate a Modelers Central Membership at any time and without prior notice.
· Modelers Central shall not be liable in any way if benefits or promotions are unavailable as a result of a technical malfunction, operator fault, errors resulting from computer hardware or software errors or failure.
· Modelers Central Membership, components of the Modelers Central Membership and its associated promotions may be amended or withdrawn by Modelers Central at any time without notice.
· Modelers Central Members participating in Modelers Central Membership Program and its associated promotions are bound by these terms and conditions and are subject to any other conditions imposed by Modelers Central or that apply to a promotion from time to time.
· All discounts for Modelers Central Members for purchases at Modelers Central are subject to stock availability.
· Modelers Central Membership discounts are not negotiable, are not transferable and cannot be redeemed for cash.
· Modelers Central Membership discounts apply to the purchase of goods from Modelers Central. Modelers Central Member discounts do not apply to any relevant shipping charges.
· A Modelers Central Member must produce their Card if seeking the benefit of any discount or other benefit offered to members, or upon request by Modelers Central.
· Modelers Central does not warrant in any way that the discounts or benefits for Modelers Central Members will be available at any particular time or times or in any particular place.
· A member of Modelers Central Member Program is not to divulge their individual username or password to another person or persons.

· Modelers Central is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by any Member whether by reason of any act or omission, deliberate or negligent, of Modelers Central in connection with Modelers Central Membership, including injury or loss incurred whilst participating in any activity of Modelers Central or Modelers Central or in any activity in which Members are invited to participate or while using any good purchased from or supplied by Modelers Central. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the greatest extent permitted by law.
· Modelers Central will not be responsible for correspondence lost or delayed in the mail or via email. Any notice will be deemed to have been given by Modelers Central if posted to the mailing address and email address last notified by a Modelers Central Member to Modelers Central.
· Each Modelers Central Member is responsible for advising Modelers Central of any change of postal address or email address.
· Notwithstanding the above, Modelers Central may inform, advise and notify Modelers Central Members by any form of communication.
· Modelers Central will not be liable for any disruption to the Modelers Central Members Program or any delay to or inability to provide any of the benefits caused by circumstances beyond the control of Modelers Central, including but not limited to strikes or industrial disputes, acts of God, flood, weather, aircraft unserviceability or unavailability, war or civil disturbance.
· Modelers Central makes no warranty or representation as to the quality, suitability, merchantability or fitness for purpose of any goods or services offered by Modelers Central for sale or as prizes.
· Modelers Central Members indemnify Modelers Central for and against any loss or claim suffered or incurred by Modelers Central arising from or in connection with a breach of these terms and conditions by a Member.

· Modelers Central holds and uses a Members personal information in accordance with Modelers Central’s privacy policy.
· Modelers Central’s decision in connection with any aspect of Modelers Central Membership will be binding and final on each Member.
· “Modelers Central” means Model Ship Building College Pty Ltd ACN 114 830 732 and includes where appropriate Modelers Central’s employees, agents, contractors, officers and related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)). “Member” means a person who has applied for membership and whose application has been accepted by Modelers Central.
· If any clause of these Terms, or any part of any clause, is or becomes illegal, invalid or unenforceable, then that part shall be severed and the remainder of the Terms shall continue in force. The words “include” and “including” and other similar words and expressions are to be construed without limitation. These Terms are governed by the laws in force in New South Wales, Australia and the parties submit to the jurisdiction of the courts of New South Wales, Australia.
· For the avoidance of doubt, these terms and conditions supersede and replace any and all previous terms and conditions governing Modelers Central Member Program.

6.0 AVAILABILITY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times. Most items in our stock list are standard stock. There may be times when we are out of stock of a particular item. Should this occur we will advise you accordingly with an estimated date for delivery. Once the item is back in stock we will ship it to you immediately.
7.0 DELIVERY AND TRACKING
Delivery of your order will be made through the national postal service of your country.
We will deliver the goods ordered by you to the delivery address you provided at the time you made your order on the website. Delivery will be made according to the information on the product pages after your order is accepted. If you provide the wrong address, we are not obliged to re-send the order at our expense to the correct address.
As proof of delivery we require a Signature on Delivery for all orders.
We are not responsible for any delay in delivery caused by the unavailability of a person at the delivery address to accept delivery of your order. If there is no person available the postal service will leave a notification advising you how or where to make arrangements to collect your delivery. It is your responsibility to contact the postal service to arrange the collection or delivery of products that could not be delivered because you were unavailable.
Once your order is booked for collection by our postal service a tracking number will be sent by email to you. You can use this tracking number to track your order through the national postal service of your country.
We endeavour to dispatch all orders on the next business day after the order is received. During times of high demand there may be a delay of a few days in shipping your order. We are not able to guarantee the delivery day or time.
We are not responsible for goods lost, stolen or damaged in transit or for the late delivery of an order. An order lost, stolen or damaged in transit or the late delivery of an order does not constitute a failure of our responsibility to supply to you the goods you have ordered, and consequently does not entitle you to cancel the order.
8.0 CUSTOMS AND IMPORT DUTY
For international orders some countries apply Customs fees, duty, taxes or import terminal charges on goods imported into that country.
The receiver of the purchase is fully responsible for their country’s customs fees, duty, taxes, or import terminal charges that may apply to your order.
Should the receiver of the purchase refuse to meet these fees the order will be returned to Modelers Central postal address.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:
- the original shipping costs stated on the order invoice;
- the return shipping costs incurred by Modelers Central for the return of the order;
- any return entry Customs fees, duty, taxes or import terminal charges that may be applied
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and
- the cost of any damage should the goods not be returned in their original condition.
When the order is returned Modelers Central will contact the purchaser by email notifying them of the final amount to be refunded.
9.0 PARTS REPLACEMENT
Any missing or broken part in your kit will be replaced for up to 30 days from the date of purchase. When you receive your kit you are required to carefully and thoroughly examine all the contents and familiarize yourself with the plans and instructions. If there is a missing or broken part advise us immediately. Check carefully as some parts of a model kit have to be made by the modeler from timber and fittings supplied in the kit. What may appear to be missing is in fact in the kit but has to be made, shaped or built by the modeler.
10.0 SPECIAL ORDERS
A number of kits in our range are identified as Special Orders – this means we can include that kit in our next order to the company who makes the kit.
In making a Special Order request we will advise you when our next order to that company will be made and that a 30% deposit will be required to confirm your Special Order.
If you decide to cancel the Special Order before we have placed the order with the company a refund of your deposit will be made. However, you cannot cancel your Special Order after we have placed the order with the company or after it has been delivered to us.
Once the Special Order has arrived we will contact you by email to advise the payment balance due which will include the shipping cost and how to make this balance payment.
A second email will be sent to you should the balance payment not be received within one week (1) week of the first email notification.
Should the payment balance not be paid within two (2) weeks of the first email notification the deposit paid will be forfeited.
Upon delivery to you of your Special Order you cannot cancel and return the Special Order to us for a refund or exchange.
The final sell price of the Special Order may change due to the kit marker’s prices when ordered, currency exchange rate changes and shipping costs.
The sell price of a Special Order is not subject to any monthly special promoted in Modelers Central newsletter of any other promotional campaign.
11.0 PRE-ORDERS
Pre-Orders can be made approximately one (1) month before we place an order to one of our suppliers. A Pre-Order selection button will be available on our website for a particular item. Full payment including shipping is required. Once a Pre-Order is made you will receive confirmation of your order and information on expected delivery.
By pre-ordering products, you acknowledge and agree to the following terms and conditions. Pre-order dates are estimates and subject to change; we do not guarantee the availability of the product at the estimated date. Your pre-order is non-refundable, except as required by applicable law. In the event of unforeseen circumstances affecting product availability, we reserve the right to cancel or delay pre-orders and will notify you promptly. Prices for pre-ordered items are fixed at the time of purchase. Any changes to the product specifications will be communicated before shipment. We are not liable for any potential changes in product features or delays. By completing a pre-order, you affirm that you have read, understood, and accepted these terms and conditions
12.0 PAYMENT
Payment for goods can be made by one of the following payment methods:

13.0 RIGHT TO CANCEL
You have the right to cancel the purchase of an order without having to give a reason at any time within 14 days of receiving your order. You must notify us of your cancellation in writing or in another durable medium to our contact address [email protected]
You are required:
- While in possession of the goods you are to retain them and take all reasonable care of them.
- To return the goods back to us in their original condition to our delivery address at your own cost (unless we delivered the item to you in error or the item is damaged or defective upon delivery to you) as soon as possible once you have cancelled the contract.
- You are responsible for the return shipping cost.
Once the order has been returned to Modelers Central a refund will be made to the purchaser for the purchase price of the goods less:
- the original shipping costs stated on the order,
- the cost of the return shipping should you not pay this cost; and
- the cost of any damage should the goods not be returned in their original condition.
When you return goods to us because you have cancelled the contract between us during the 14 days we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
You do not have any right to cancel a purchase:
- after it has been despatched from our warehouse and collected by our courier service.
- for the supply of goods the price of which is dependent on fluctuations in the financial market which cannot be controlled by the supplier;
- for the supply of goods made to your specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly;
- DVDs cannot be returned or exchanged unless the DVD is found to be faulty.
- Plans cannot be returned or exchanged.
- Electrically operated tools or equipment cannot be returned for refund or exchanged where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.
- Special Orders cannot be exchanged, canceled or returned for a refund.
14.0 MONTHLY SPECIALS
Please note there is no refund or exchange for our monthly specials as per distributed via email.
15.0 CANCELLATION BY US
We reserve the right to cancel the contract between us if, for example:
- we have insufficient stock to deliver the goods you have ordered;
- we do not deliver to your location/country; or
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order.
16.0 RETURNS AND REFUNDS POLICY
If you want a refund you must notify us by email to [email protected] within 30 days from the date of delivery of your order. You must provide a reason for wanting a refund.
If you have changed your mind Modelers Central may, at its sole discretion allow a refund or an exchange of goods.
A cost of goods refund will only be provided if the goods purchased are:
- not of acceptable quality; or
- do not match the description presented on our website; and
- returned to us in their original condition.
A cost of goods refund will not be made if you return the goods to us and they are found to have been altered in any way while in your possession. This includes the packaging containing the goods.
The following conditions apply to the return of goods:
- include a copy of the original invoice you received with your order.
- you are responsible for the return shipping cost and any associated import costs.
- you are required to pack the order carefully and securely.
- if returning a kit you are required to ensure the kit box is securely packaged and the internal contents of the kit box are made secure to avoid damage to the contents during transit to us.
- if on return to us the kit is found to be damaged in any way, either externally or any of the internal contents are damaged in any way, you will be responsible for the cost of replacing any such damage.
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee will apply to all returns
- goods returned with the claim that they are faulty will be repaired or replaced at the sole discretion of Modelers Central.
- where goods are returned with the claim that they are faulty or incorrectly supplied and these goods are subsequently found not to be faulty or not incorrectly supplied, the purchaser will be responsible for the return shipping cost.
The following stock items can not be returned or exchanged:
- Special Orders cannot be returned or exchanged.
- DVDs – unless the DVD is found to be faulty.
- Model Ship Plans
- Electrically operated tools where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:

- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and

You will become the owner of the goods you have ordered when they have been delivered to you and we have received clear funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
19.0 LIABILITY
We are not responsible if you cannot access the site properly or at all because of any event outside our control, for example (without limitation) the performance of your or our ISP, your browser or the internet. This site relies in part on software to work. Whilst we will monitor the site, we cannot guarantee that the site or any individual feature of the site will be error free, available all the time and/or free from viruses. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content. Nothing in these terms will affect any liability we may have:
(a) for fraudulent misrepresentation;

We will have no liability to you for any delay in delivering goods you have ordered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion.
21.0 INVALIDITY
If any part of these terms is unenforceable, the enforceability of any other part of these terms will not be affected.
22.0 LAW AND JURISDICTION
These terms are governed by Australian law, and any contracts formed between via this site will be governed by Australian law. The Australian courts will have exclusive jurisdiction over any dispute relating to these terms or any contracts between us.
23.0 GENERAL
Modelers Central is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by a customer while using any good purchased from or supplied by Modelers Central. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the greatest extent permitted by law.
Modelers Central reserves the right to refuse service to any customer who either explicitly or implicitly threatens, abuses, harasses or makes defamatory remarks via any form of communication to any employee or officer of Modelers Central.
Refusal of service to a customer also applies to explicit or implicit threats to Modelers Central via any form of communication.
Any order placed by a customer who is refused service will be cancelled and a refund processed.
No correspondence will be entered into in relation to the refusal of service to a customer.
Relevant and appropriate legal action may be taken against the perpetrator of any defamatory statements about Modelers Central made by any form of communication including social media.
Using Modelers Central website to access, send or post any material of an offensive, obscene, pornographic, threatening, abusive or defamatory nature is a breach of these terms and conditions.
24.0 NOTICES
All notices you send us must be sent to the contact details on this Website. We may give notice to you at either the e-mail or postal address you provide to us when making a purchase. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that the e-mail was sent to the specified e-mail address of the addressee.

By applying to become a Modelers Central Member the applicant agrees to be bound by these Modelers Central Membership terms and conditions. These terms and conditions are binding on an applicant upon the processing of the application.
· Only individuals can apply to become a Modelers Central Member. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
· Modelers Central may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application from an individual to become an member.
· To apply to become a Modelers Central Member, the applicant must complete and submit the on-line application at www.www.modelerscentral.com and pay the relevant non-refundable membership fee.
· A Modelers Central Member may hold one (1) membership only.
· Modelers Central Member benefits are determined by Modelers Central from time to time and may include discounts for products purchased at Modelers Central.
· Discounts only apply to the Modelers Central Member named on the membership card.
· The benefits of a Modelers Central Member are non-transferable and are not redeemable for cash.

9.0 PARTS REPLACEMENT
Any missing or broken part in your kit will be replaced for up to 30 days from the date of purchase. When you receive your kit you are required to carefully and thoroughly examine all the contents and familiarize yourself with the plans and instructions. If there is a missing or broken part advise us immediately. Check carefully as some parts of a model kit have to be made by the modeler from timber and fittings supplied in the kit. What may appear to be missing is in fact in the kit but has to be made, shaped or built by the modeler.
10.0 SPECIAL ORDERS
A number of kits in our range are identified as Special Orders – this means we can include that kit in our next order to the company who makes the kit.
In making a Special Order request we will advise you when our next order to that company will be made and that a 30% deposit will be required to confirm your Special Order.
If you decide to cancel the Special Order before we have placed the order with the company a refund of your deposit will be made. However, you cannot cancel your Special Order after we have placed the order with the company or after it has been delivered to us.
Once the Special Order has arrived we will contact you by email to advise the payment balance due which will include the shipping cost and how to make this balance payment.
A second email will be sent to you should the balance payment not be received within one week (1) week of the first email notification.
Should the payment balance not be paid within two (2) weeks of the first email notification the deposit paid will be forfeited.
Upon delivery to you of your Special Order you cannot cancel and return the Special Order to us for a refund or exchange.
The final sell price of the Special Order may change due to the kit marker’s prices when ordered, currency exchange rate changes and shipping costs.
The sell price of a Special Order is not subject to any monthly special promoted in Modelers Central newsletter of any other promotional campaign.
11.0 PRE-ORDERS
Pre-Orders can be made approximately one (1) month before we place an order to one of our suppliers. A Pre-Order selection button will be available on our website for a particular item. Full payment including shipping is required. Once a Pre-Order is made you will receive confirmation of your order and information on expected delivery.
By pre-ordering products, you acknowledge and agree to the following terms and conditions. Pre-order dates are estimates and subject to change; we do not guarantee the availability of the product at the estimated date. Your pre-order is non-refundable, except as required by applicable law. In the event of unforeseen circumstances affecting product availability, we reserve the right to cancel or delay pre-orders and will notify you promptly. Prices for pre-ordered items are fixed at the time of purchase. Any changes to the product specifications will be communicated before shipment. 13.0 RIGHT TO CANCEL

- While in possession of the goods you are to retain them and take all reasonable care of them.

14.0 MONTHLY SPECIALS
Please note there is no refund or exchange for our monthly specials as per distributed via email.
15.0 CANCELLATION BY US
We reserve the right to cancel the contract between us if, for example:
- we have insufficient stock to deliver the goods you have ordered;
- we do not deliver to your location/country; or
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order.
16.0 RETURNS AND REFUNDS POLICY

If you have changed your mind Modelers Central may, at its sole discretion allow a refund or an exchange of goods.
A cost of goods refund will only be provided if the goods purchased are:

- returned to us in their original condition.
A cost of goods refund will not be made if you return the goods to us and they are found to have been altered in any way while in your possession. This includes the packaging containing the goods.

- you are required to pack the order carefully and securely.
- if returning a kit you are required to ensure the kit box is securely packaged and the internal contents of the kit box are made secure to avoid damage to the contents during transit to us.
- if on return to us the kit is found to be damaged in any way, either externally or any of the internal contents are damaged in any way, you will be responsible for the cost of replacing any such damage.

Refusal of service to a customer also applies to explicit or implicit threats to Modelers Central via any form of communication.
Any order placed by a customer who is refused service will be cancelled and a refund processed.
No correspondence will be entered into in relation to the refusal of service to a customer.

By applying to become a Modelers Central Member the applicant agrees to be bound by these Modelers Central Membership terms and conditions. These terms and conditions are binding on an applicant upon the processing of the application.
· Only individuals can apply to become a Modelers Central Member. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
· Modelers Central may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application from an individual to become an member.
· To apply to become a Modelers Central Member, the applicant must complete and submit the on-line application at www.www.modelerscentral.com and pay the relevant non-refundable membership fee.
· A Modelers Central Member may hold one (1) membership only.
· Modelers Central Member benefits are determined by Modelers Central from time to time and may include discounts for products purchased at Modelers Central.
· Discounts only apply to the Modelers Central Member named on the membership card.
· The benefits of a Modelers Central Member are non-transferable and are not redeemable for cash.

Modelers Central ships to most destinations around the world.

Shipping rates will depend on the value of your order and the delivery location. Shipping costs will be displayed at checkout. The total shipping costs include insurance.
Tracking details will be sent to you by email.
Delivery times depend on the destination of your order. Domestic delivery times are usually 2 to 4 business days. International delivery times are usually 6 to 10 business days.
A timber surcharge will be applied to all orders of timber strips and lengths of brass rod. This surcharge is applied due to the additional costs of shipping long items.
The total shipping and postal charge will be presented to you before you finalize and submit your order.
6.0 AVAILABILITY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times. Most items in our stock list are standard stock. There may be times when we are out of stock of a particular item. 7.0 DELIVERY AND TRACKING
Delivery of your order will be made through the national postal service of your country.
We will deliver the goods ordered by you to the delivery address you provided at the time you made your order on the website. If you provide the wrong address, we are not obliged to re-send the order at our expense to the correct address.
As proof of delivery we require a Signature on Delivery for all orders.

When you return goods to us because you have cancelled the contract between us during the 14 days we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
You do not have any right to cancel a purchase:
- after it has been despatched from our warehouse and collected by our courier service.
- for the supply of goods the price of which is dependent on fluctuations in the financial market which cannot be controlled by the supplier;

13.0 MONTHLY SPECIALS
Please note there is no refund or exchange for our monthly specials as per distributed via email.
14.0 CANCELLATION BY US
We reserve the right to cancel the contract between us if, for example:
- we have insufficient stock to deliver the goods you have ordered;
- we do not deliver to your location/country; or
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order.
15.0 REFUNDS POLICY
If you want a refund you must notify us by email to [email protected] within 30 days from the date of delivery of your order. You must provide a reason for wanting a refund.
If you have changed your mind Modelers Central may, at its sole discretion allow a refund or an exchange of goods.
A cost of goods refund will only be provided if the goods purchased are:
- not of acceptable quality; or
- do not match the description presented on our website; and
- returned to us in their original condition.
A cost of goods refund will not be made if you return the goods to us and they are found to have been altered in any way while in your possession. This includes the packaging containing the goods.
The following conditions apply to the return of goods:
- include a copy of the original invoice you received with your order.
- you are responsible for the return shipping cost and any associated import costs.
- you are required to pack the order carefully and securely.
- if returning a kit you are required to ensure the kit box is securely packaged and the internal contents of the kit box are made secure to avoid damage to the contents during transit to us.
- if on return to us the kit is found to be damaged in any way, either externally or any of the internal contents are damaged in any way, you will be responsible for the cost of replacing any such damage.
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee will apply to all returns
- goods returned with the claim that they are faulty will be repaired or replaced at the sole discretion of Modelers Central.
- where goods are returned with the claim that they are faulty or incorrectly supplied and these goods are subsequently found not to be faulty or not incorrectly supplied, the purchaser will be responsible for the return shipping cost.
The following stock items can not be returned or exchanged:
- Special Orders cannot be returned or exchanged.
- DVDs – unless the DVD is found to be faulty.
- Model Ship Plans
- Electrically operated tools where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:
- the original shipping costs stated on the order invoice;
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and
- the cost of any damage should the goods not be returned in their original condition.
When the order is returned Modelers Central will contact the purchaser by email notifying them of the final amount to be refunded.
By returning the goods to us you have cancelled the contract between us. We will process the refund due to you as soon as possible and, in any case, within 30 days of the date of receiving the returned goods.

You will become the owner of the goods you have ordered when they have been delivered to you and we have received clear funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

We are not responsible if you cannot access the site properly or at all because of any event outside our control, for example (without limitation) the performance of your or our ISP, your browser or the internet. This site relies in part on software to work. Whilst we will monitor the site, we cannot guarantee that the site or any individual feature of the site will be error free, available all the time and/or free from viruses. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content. Nothing in these terms will affect any liability we may have:

We will have no liability to you for any delay in delivering goods you have ordered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion.
19.0 INVALIDITY
If any part of these terms is unenforceable, the enforceability of any other part of these terms will not be affected.
20.0 LAW AND JURISDICTION
These terms are governed by Australian law, and any contracts formed between via this site will be governed by Australian law. The Australian courts will have exclusive jurisdiction over any dispute relating to these terms or any contracts between us.
21.0 GENERAL
Modelers Central is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by a customer while using any good purchased from or supplied by Modelers Central. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the greatest extent permitted by law.
Modelers Central reserves the right to refuse service to any customer who either explicitly or implicitly threatens, abuses, harasses or makes defamatory remarks via any form of communication to any employee or officer of Modelers Central.
Refusal of service to a customer also applies to explicit or implicit threats to Modelers Central via any form of communication.
Any order placed by a customer who is refused service will be cancelled and a refund processed.
No correspondence will be entered into in relation to the refusal of service to a customer.
Relevant and appropriate legal action may be taken against the perpetrator of any defamatory statements about Modelers Central made by any form of communication including social media.
Using Modelers Central website to access, send or post any material of an offensive, obscene, pornographic, threatening, abusive or defamatory nature is a breach of these terms and conditions.

All notices you send us must be sent to the contact details on this Website. We may give notice to you at either the e-mail or postal address you provide to us when making a purchase. By applying to become a Modelers Central Member the applicant agrees to be bound by these Modelers Central Membership terms and conditions. These terms and conditions are binding on an applicant upon the processing of the application.
· Only individuals can apply to become a Modelers Central Member. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
· Modelers Central may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application from an individual to become an member.
· To apply to become a Modelers Central Member, the applicant must complete and submit the on-line application at www.www.modelerscentral.com and pay the relevant non-refundable membership fee.
· A Modelers Central Member may hold one (1) membership only.
· Modelers Central Member benefits are determined by Modelers Central from time to time and may include discounts for products purchased at Modelers Central.
· Discounts only apply to the Modelers Central Member named on the membership card.
· The benefits of a Modelers Central Member are non-transferable and are not redeemable for cash.
· Modelers Central Membership is valid for a period of 24 months from date of application and fee payment or is terminated or cancelled by Modelers Central (in its absolute discretion) or until the Cardholder notifies Modelers Central at [email protected] that he/she wishes to terminate their Membership. If membership is terminated the membership fee is non-refundable.

· All membership cards remain the property of Modelers Central. Cards must be returned to Modelers Central immediately on demand by Modelers Central.

· Modelers Central reserves the right to suspend or terminate a Modelers Central Membership at any time and without prior notice.

· Modelers Central Membership, components of the Modelers Central Membership and its associated promotions may be amended or withdrawn by Modelers Central at any time without notice.

· Each Modelers Central Member is responsible for advising Modelers Central of any change of postal address or email address.
· Notwithstanding the above, Modelers Central may inform, advise and notify Modelers Central Members by any form of communication.
· Modelers Central will not be liable for any disruption to the Modelers Central Members Program or any delay to or inability to provide any of the benefits caused by circumstances beyond the control of Modelers Central, including but not limited to strikes or industrial disputes, acts of God, flood, weather, aircraft unserviceability or unavailability, war or civil disturbance.
· Modelers Central makes no warranty or representation as to the quality, suitability, merchantability or fitness for purpose of any goods or services offered by Modelers Central for sale or as prizes.

5.0 SHIPPING & POSTAL CHARGES
All prices shown on our website exclude shipping & postal costs. Shipping & postal costs depend upon the items and value of your order and your delivery location.
Modelers Central ships to most destinations around the world.
When entering your delivery address details in the shopping cart please ensure you select the correct country from the drop down menu.
Shipping rates will depend on the value of your order and the delivery location. Shipping costs will be displayed at checkout. The total shipping costs include insurance.
Tracking details will be sent to you by email.
Delivery times depend on the destination of your order. Domestic delivery times are usually 2 to 4 business days. International delivery times are usually 6 to 10 business days.
A timber surcharge will be applied to all orders of timber strips and lengths of brass rod. This surcharge is applied due to the additional costs of shipping long items.
The total shipping and postal charge will be presented to you before you finalize and submit your order.
6.0 AVAILABILITY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times. Most items in our stock list are standard stock. There may be times when we are out of stock of a particular item. Should this occur we will advise you accordingly with an estimated date for delivery. Once the item is back in stock we will ship it to you immediately.
7.0 DELIVERY AND TRACKING
Delivery of your order will be made through the national postal service of your country.
We will deliver the goods ordered by you to the delivery address you provided at the time you made your order on the website. Delivery will be made according to the information on the product pages after your order is accepted. If you provide the wrong address, we are not obliged to re-send the order at our expense to the correct address.
As proof of delivery we require a Signature on Delivery for all orders.
We are not responsible for any delay in delivery caused by the unavailability of a person at the delivery address to accept delivery of your order. If there is no person available the postal service will leave a notification advising you how or where to make arrangements to collect your delivery. It is your responsibility to contact the postal service to arrange the collection or delivery of products that could not be delivered because you were unavailable.
Once your order is booked for collection by our postal service a tracking number will be sent by email to you. You can use this tracking number to track your order through the national postal service of your country.
We endeavour to dispatch all orders on the next business day after the order is received. At times there may be a carry over to the following business day before the order is shipped. We can provide you with an estimated date of delivery of all parcels. We are not able to guarantee the delivery day or time.
We are not responsible for goods lost, stolen or damaged in transit or for the late delivery of an order. An order lost, stolen or damaged in transit or the late delivery of an order does not constitute a failure of our responsibility to supply to you the goods you have ordered, and consequently does not entitle you to cancel the order.
8.0 CUSTOMS AND IMPORT DUTY
For international orders some countries apply Customs fees, duty, taxes or import terminal charges on goods imported into that country.
As the purchaser you are fully responsible for your country’s customs fees, duty, taxes, or import terminal charges that may apply to your order.
Should the purchaser refuse to meet these fees the order will be returned to Modelers Central postal address.

9.0 PARTS REPLACEMENT
Any missing or broken part in your kit will be replaced for up to 30 days from the date of purchase. When you receive your kit you are required to carefully and thoroughly examine all the contents and familiarize yourself with the plans and instructions. If there is a missing or broken part advise us immediately. Check carefully as some parts of a model kit have to be made by the modeler from timber and fittings supplied in the kit. What may appear to be missing is in fact in the kit but has to be made, shaped or built by the modeler.
10.0 SPECIAL ORDERS
A number of kits in our range are identified as Special Orders – this means we can include that kit in our next order to the company who makes the kit.
In making a Special Order request we will advise you when our next order to that company will be made and that a 30% deposit will be required to confirm your Special Order.
If you decide to cancel the Special Order before we have placed the order with the company a refund of your deposit will be made. However, you cannot cancel your Special Order after we have placed the order with the company or after it has been delivered to us.
Once the Special Order has arrived we will contact you by email to advise the payment balance due which will include the shipping cost and how to make this balance payment.
A second email will be sent to you should the balance payment not be received within one week (1) week of the first email notification.
Should the payment balance not be paid within two (2) weeks of the first email notification the deposit paid will be forfeited.
Upon delivery to you of your Special Order you cannot cancel and return the Special Order to us for a refund or exchange.
The price of the Special Order is fixed at the point when the deposit payment is made.
The price of a Special Order is not subject to any monthly special promoted in Modelers Central newsletter or any other promotional campaign.
11.0 PRE-ORDERS
Pre-Orders can be made approximately one (1) month before we place an order with one of our suppliers.
A Pre-Order selection button is available on our website for selected item.
The full purchase price plus shipping is required at the time of placing the Pre-Order.
Once the Pre-Order has been made a confirmation email will be sent along with expected delivery.
If you decide to cancel the Pre-Order before we have placed the order with the company a refund will be made. However, you cannot cancel your Pre-Order after we have placed the order with the company.
The price of a Pre-Order product is not subject to any monthly special promoted in Modelers Central newsletter or any other promotional campaign. Modelers Central membership discount is applicable.
By pre-ordering products, you acknowledge and agree to the following terms and conditions. 18.0 TITLE AND RISK
You will become the owner of the goods you have ordered when they have been delivered to you and we have received clear funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

By applying to become a Modelers Central Member the applicant agrees to be bound by these Modelers Central Membership terms and conditions. These terms and conditions are binding on an applicant upon the processing of the application.
· Only individuals can apply to become a Modelers Central Member. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
· Modelers Central may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application from an individual to become an member.
· To apply to become a Modelers Central Member, the applicant must complete and submit the on-line application at www.www.modelerscentral.com and pay the relevant non-refundable membership fee.
· A Modelers Central Member may hold one (1) membership only.
· Modelers Central Member benefits are determined by Modelers Central from time to time and may include discounts for products purchased at Modelers Central.
· Discounts only apply to the Modelers Central Member named on the membership card.
· The benefits of a Modelers Central Member are non-transferable and are not redeemable for cash.

5.0 SHIPPING & POSTAL CHARGES
All prices shown on our website exclude shipping & postal costs. Shipping & postal costs depend upon the items and value of your order and your delivery location.
Modelers Central ships to most destinations around the world.
When entering your delivery address details in the shopping cart please ensure you select the correct country from the drop down menu.
Shipping rates will depend on the value of your order and the delivery location. Shipping costs will be displayed at checkout. The total shipping costs include insurance.
Tracking details will be sent to you by email.
Delivery times depend on the destination of your order. Domestic delivery times are usually 2 to 4 business days. International delivery times are usually 6 to 10 business days.
A timber surcharge will be applied to all orders of timber strips and lengths of brass rod. This surcharge is applied due to the additional costs of shipping long items.
The total shipping and postal charge will be presented to you before you finalize and submit your order.
6.0 AVAILABILITY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times. Most items in our stock list are standard stock. There may be times when we are out of stock of a particular item. Should this occur we will advise you accordingly with an estimated date for delivery. Once the item is back in stock we will ship it to you immediately.
7.0 DELIVERY AND TRACKING
Delivery of your order will be made through the national postal service of your country.
We will deliver the goods ordered by you to the delivery address you provided at the time you made your order on the website. Delivery will be made according to the information on the product pages after your order is accepted. If you provide the wrong address, we are not obliged to re-send the order at our expense to the correct address.
As proof of delivery we require a Signature on Delivery for all orders.
We are not responsible for any delay in delivery caused by the unavailability of a person at the delivery address to accept delivery of your order. If there is no person available the postal service will leave a notification advising you how or where to make arrangements to collect your delivery. It is your responsibility to contact the postal service to arrange the collection or delivery of products that could not be delivered because you were unavailable.
Once your order is booked for collection by our postal service a tracking number will be sent by email to you. You can use this tracking number to track your order through the national postal service of your country.
We endeavour to dispatch all orders on the next business day after the order is received. At times there may be a carry over to the following business day before the order is shipped. We can provide you with an estimated date of delivery of all parcels. We are not able to guarantee the delivery day or time.
We are not responsible for goods lost, stolen or damaged in transit or for the late delivery of an order. An order lost, stolen or damaged in transit or the late delivery of an order does not constitute a failure of our responsibility to supply to you the goods you have ordered, and consequently does not entitle you to cancel the order.
8.0 CUSTOMS AND IMPORT DUTY
For international orders some countries apply Customs fees, duty, taxes or import terminal charges on goods imported into that country.
As the purchaser you are fully responsible for your country’s customs fees, duty, taxes, or import terminal charges that may apply to your order.
Should the purchaser refuse to meet these fees the order will be returned to Modelers Central postal address.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:
- the original shipping costs stated on the order invoice;
- the return shipping costs incurred by Modelers Central for the return of the order;
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and
- the cost of any damage should the goods not be returned in their original condition.
When the order is returned Modelers Central will contact the purchaser by email notifying them of the final amount to be refunded.
9.0 PARTS REPLACEMENT
Any missing or broken part in your kit will be replaced for up to 30 days from the date of purchase. When you receive your kit you are required to carefully and thoroughly examine all the contents and familiarize yourself with the plans and instructions. If there is a missing or broken part advise us immediately. Check carefully as some parts of a model kit have to be made by the modeler from timber and fittings supplied in the kit. What may appear to be missing is in fact in the kit but has to be made, shaped or built by the modeler.
10.0 SPECIAL ORDERS
A number of kits in our range are identified as Special Orders – this means we can include that kit in our next order to the company who makes the kit.
In making a Special Order request we will advise you when our next order to that company will be made and that a 30% deposit will be required to confirm your Special Order.
If you decide to cancel the Special Order before we have placed the order with the company a refund of your deposit will be made. However, you cannot cancel your Special Order after we have placed the order with the company or after it has been delivered to us.
Once the Special Order has arrived we will contact you by email to advise the payment balance due which will include the shipping cost and how to make this balance payment.
A second email will be sent to you should the balance payment not be received within one week (1) week of the first email notification.
Should the payment balance not be paid within two (2) weeks of the first email notification the deposit paid will be forfeited.
Upon delivery to you of your Special Order you cannot cancel and return the Special Order to us for a refund or exchange.
The price of the Special Order is fixed at the point when the deposit payment is made.
The price of a Special Order is not subject to any monthly special promoted in Modelers Central newsletter of any other promotional campaign.
11.0 PAYMENT
Payment for goods can be made by one of the following payment methods:

12.0 RIGHT TO CANCEL
You have the right to cancel the purchase of an order without having to give a reason at any time within 14 days of receiving your order. You must notify us of your cancellation in writing or in another durable medium to our contact address [email protected]
You are required:
- While in possession of the goods you are to retain them and take all reasonable care of them.
- To return the goods back to us in their original condition to our delivery address at your own cost (unless we delivered the item to you in error or the item is damaged or defective upon delivery to you) as soon as possible once you have cancelled the contract.
Once the order has been returned to Modelers Central a refund will be made to the purchaser for the purchase price of the goods less:
- the original shipping costs stated on the order; and
- the cost of any damage should the goods not be returned in their original condition.
We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
When you return goods to us because you have cancelled the contract between us during the 14 days we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
You do not have any right to cancel a purchase:
- after it has been despatched from our warehouse and collected by our courier service.
- for the supply of goods the price of which is dependent on fluctuations in the financial market which cannot be controlled by the supplier;
- for the supply of goods made to your specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly;
- DVDs cannot be returned or exchanged unless the DVD is found to be faulty.

13.0 MONTHLY SPECIALS
Please note there is no refund or exchange for our monthly specials as per distributed via email.
14.0 CANCELLATION BY US
We reserve the right to cancel the contract between us if, for example:
- we have insufficient stock to deliver the goods you have ordered;
- we do not deliver to your location/country; or
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order.
15.0 REFUNDS POLICY
If you want a refund you must notify us by email to [email protected] within 30 days from the date of delivery of your order. You must provide a reason for wanting a refund.
If you have changed your mind Modelers Central may, at its sole discretion allow a refund or an exchange of goods.
A cost of goods refund will only be provided if the goods purchased are:
- not of acceptable quality; or

- returned to us in their original condition.
A cost of goods refund will not be made if you return the goods to us and they are found to have been altered in any way while in your possession. This includes the packaging containing the goods.
The following conditions apply to the return of goods:
- include a copy of the original invoice you received with your order.
- you are responsible for the return shipping cost and any associated import costs.
- you are required to pack the order carefully and securely.
- if returning a kit you are required to ensure the kit box is securely packaged and the internal contents of the kit box are made secure to avoid damage to the contents during transit to us.
- if on return to us the kit is found to be damaged in any way, either externally or any of the internal contents are damaged in any way, you will be responsible for the cost of replacing any such damage.
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee will apply to all returns
- goods returned with the claim that they are faulty will be repaired or replaced at the sole discretion of Modelers Central.
- where goods are returned with the claim that they are faulty or incorrectly supplied and these goods are subsequently found not to be faulty or not incorrectly supplied, the purchaser will be responsible for the return shipping cost.
The following stock items can not be returned or exchanged:

Where the correct price of the goods is less than our stated price, we will charge the lower amount on dispatch. If the correct price of the goods is higher than the price stated on our site, we may, if possible, reject your order at our discretion, in which case we will notify you of such rejection and the correct price for the goods.
5.0 SHIPPING & POSTAL CHARGES
All prices shown on our website exclude shipping & postal costs. Shipping & postal costs depend upon the items and value of your order and your delivery location.
Modelers Central ships to most destinations around the world.
When entering your delivery address details in the shopping cart please ensure you select the correct country from the drop down menu.
Shipping rates will depend on the value of your order and the delivery location. Shipping costs will be displayed at checkout. The total shipping costs include insurance.
Tracking details will be sent to you by email.
Delivery times depend on the destination of your order. Domestic delivery times are usually 2 to 4 business days. International delivery times are usually 6 to 10 business days.
A timber surcharge will be applied to all orders of timber strips and lengths of brass rod. This surcharge is applied due to the additional costs of shipping long items.
The total shipping and postal charge will be presented to you before you finalize and submit your order.
6.0 AVAILABILITY
Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times. Most items in our stock list are standard stock. There may be times when we are out of stock of a particular item. Should this occur we will advise you accordingly with an estimated date for delivery. Once the item is back in stock we will ship it to you immediately.
7.0 DELIVERY AND TRACKING
Delivery of your order will be made through the national postal service of your country.
We will deliver the goods ordered by you to the delivery address you provided at the time you made your order on the website. Delivery will be made according to the information on the product pages after your order is accepted. If you provide the wrong address, we are not obliged to re-send the order at our expense to the correct address.
As proof of delivery we require a Signature on Delivery for all orders.
We are not responsible for any delay in delivery caused by the unavailability of a person at the delivery address to accept delivery of your order. If there is no person available the postal service will leave a notification advising you how or where to make arrangements to collect your delivery. It is your responsibility to contact the postal service to arrange the collection or delivery of products that could not be delivered because you were unavailable.
Once your order is booked for collection by our postal service a tracking number will be sent by email to you. You can use this tracking number to track your order through the national postal service of your country.
We endeavour to dispatch all orders on the next business day after the order is received. At times there may be a carry over to the following business day before the order is shipped. We can provide you with an estimated date of delivery of all parcels. We are not able to guarantee the delivery day or time.
We are not responsible for goods lost, stolen or damaged in transit or for the late delivery of an order. An order lost, stolen or damaged in transit or the late delivery of an order does not constitute a failure of our responsibility to supply to you the goods you have ordered, and consequently does not entitle you to cancel the order.
8.0 CUSTOMS AND IMPORT DUTY
For international orders some countries apply Customs fees, duty, taxes or import terminal charges on goods imported into that country.
As the purchaser you are fully responsible for your country’s customs fees, duty, taxes, or import terminal charges that may apply to your order.
Should the purchaser refuse to meet these fees the order will be returned to Modelers Central postal address.
When the order is returned to Modelers Central a refund will be made to the purchaser for the original total invoice amount (goods plus shipping) less:
- the original shipping costs stated on the order invoice;
- the return shipping costs incurred by Modelers Central for the return of the order;
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee and
- the cost of any damage should the goods not be returned in their original condition.
When the order is returned Modelers Central will contact the purchaser by email notifying them of the final amount to be refunded.
9.0 PARTS REPLACEMENT
Any missing or broken part in your kit will be replaced for up to 30 days from the date of purchase. When you receive your kit you are required to carefully and thoroughly examine all the contents and familiarize yourself with the plans and instructions. If there is a missing or broken part advise us immediately. Check carefully as some parts of a model kit have to be made by the modeler from timber and fittings supplied in the kit. What may appear to be missing is in fact in the kit but has to be made, shaped or built by the modeler.
10.0 SPECIAL ORDERS
A number of kits in our range are identified as Special Orders – this means we can include that kit in our next order to the company who makes the kit.
In making a Special Order request we will advise you when our next order to that company will be made and that a 30% deposit will be required to confirm your Special Order.
If you decide to cancel the Special Order before we have placed the order with the company a refund of your deposit will be made. However, you cannot cancel your Special Order after we have placed the order with the company or after it has been delivered to us.
Once the Special Order has arrived we will contact you by email to advise the payment balance due which will include the shipping cost and how to make this balance payment.
A second email will be sent to you should the balance payment not be received within one week (1) week of the first email notification.
Should the payment balance not be paid within two (2) weeks of the first email notification the deposit paid will be forfeited.
Upon delivery to you of your Special Order you cannot cancel and return the Special Order to us for a refund or exchange.
The price of the Special Order is fixed at the point when the deposit payment is made.
The price of a Special Order is not subject to any monthly special promoted in Modelers Central newsletter of any other promotional campaign.
11.0 PAYMENT
Payment for goods can be made by one of the following payment methods:

- Credit card VISA, MASTERCARD
- Debit card VISA, MASTERCARD
12.0 RIGHT TO CANCEL
You have the right to cancel the purchase of an order without having to give a reason at any time within 14 days of receiving your order. You must notify us of your cancellation in writing or in another durable medium to our contact address [email protected]
You are required:
- While in possession of the goods you are to retain them and take all reasonable care of them.
- To return the goods back to us in their original condition to our delivery address at your own cost (unless we delivered the item to you in error or the item is damaged or defective upon delivery to you) as soon as possible once you have cancelled the contract.
Once the order has been returned to Modelers Central a refund will be made to the purchaser for the purchase price of the goods less:
- the original shipping costs stated on the order; and
- the cost of any damage should the goods not be returned in their original condition.
We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
When you return goods to us because you have cancelled the contract between us during the 14 days we will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
You do not have any right to cancel a purchase:
- after it has been despatched from our warehouse and collected by our courier service.
- for the supply of goods the price of which is dependent on fluctuations in the financial market which cannot be controlled by the supplier;
- for the supply of goods made to your specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly;
- DVDs cannot be returned or exchanged unless the DVD is found to be faulty.
- Plans cannot be returned or exchanged.
- Electrically operated tools or equipment cannot be returned for refund or exchanged where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.
- Special Orders cannot be exchanged, canceled or returned for a refund.
13.0 MONTHLY SPECIALS
Please note there is no refund or exchange for our monthly specials as per distributed via email.
14.0 CANCELLATION BY US
We reserve the right to cancel the contract between us if, for example:
- we have insufficient stock to deliver the goods you have ordered;
- we do not deliver to your location/country; or
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by email and will re-credit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order.
15.0 REFUNDS POLICY
If you want a refund you must notify us by email to [email protected] within 30 days from the date of delivery of your order. You must provide a reason for wanting a refund.
If you have changed your mind Modelers Central may, at its sole discretion allow a refund or an exchange of goods.
A cost of goods refund will only be provided if the goods purchased are:
- not of acceptable quality; or
- do not match the description presented on our website; and
- returned to us in their original condition.
A cost of goods refund will not be made if you return the goods to us and they are found to have been altered in any way while in your possession. This includes the packaging containing the goods.
The following conditions apply to the return of goods:
- include a copy of the original invoice you received with your order.
- you are responsible for the return shipping cost and any associated import costs.
- you are required to pack the order carefully and securely.
- if returning a kit you are required to ensure the kit box is securely packaged and the internal contents of the kit box are made secure to avoid damage to the contents during transit to us.
- if on return to us the kit is found to be damaged in any way, either externally or any of the internal contents are damaged in any way, you will be responsible for the cost of replacing any such damage.
- a 25 USD/GBP/Euro/AUD Restocking & Administration Fee will apply to all returns
- goods returned with the claim that they are faulty will be repaired or replaced at the sole discretion of Modelers Central.
- where goods are returned with the claim that they are faulty or incorrectly supplied and these goods are subsequently found not to be faulty or not incorrectly supplied, the purchaser will be responsible for the return shipping cost.
The following stock items can not be returned or exchanged:
- Special Orders cannot be returned or exchanged.
- DVDs – unless the DVD is found to be faulty.
- Model Ship Plans
- Electrically operated tools where that tool or equipment has been found to have been incorrectly operated, or incorrectly connected to the electrical supply or operated in any unsafe manner.

This site relies in part on software to work. Whilst we will monitor the site, we cannot guarantee that the site or any individual feature of the site will be error free, available all the time and/or free from viruses. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content. Nothing in these terms will affect any liability we may have:

Refusal of service to a customer also applies to explicit or implicit threats to Modelers Central via any form of communication.
Any order placed by a customer who is refused service will be cancelled and a refund processed.
No correspondence will be entered into in relation to the refusal of service to a customer.
Relevant and appropriate legal action may be taken against the perpetrator of any defamatory statements about Modelers Central made by any form of communication including social media.

By applying to become a Modelers Central Member the applicant agrees to be bound by these Modelers Central Membership terms and conditions. These terms and conditions are binding on an applicant upon the processing of the application.
· Only individuals can apply to become a Modelers Central Member. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
· Modelers Central may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application from an individual to become an member.
· To apply to become a Modelers Central Member, the applicant must complete and submit the on-line application at www.www.modelerscentral.com and pay the relevant non-refundable membership fee.
· A Modelers Central Member may hold one (1) membership only.
· Modelers Central Member benefits are determined by Modelers Central from time to time and may include discounts for products purchased at Modelers Central.
· Discounts only apply to the Modelers Central Member named on the membership card.
· The benefits of a Modelers Central Member are non-transferable and are not redeemable for cash.
